Is Delta-8 Legal? 

The U.S. has a complicated relationship with cannabis, so it’s not surprising that delta-8 products find themselves floating in murky legal waters. States Laws on Delta-8

As the production of delta-8 products is largely unregulated, many states have decided to wait until more research is available to legalize delta-8. Currently, 34 states allow production, sales, possession, or consumption of delta-8. However, delta-8 is restricted or illegal in the following states: Alaska, Arizona, Arkansas, Colorado, Connecticut, Delaware, Idaho, Iowa, Kentucky, Michigan, Mississippi, Montana, New York, North Dakota, Rhode Island, Texas, Utah, Vermont, and Washington. Delta-8’s legality is pending review in Alabama, Illinois, Oklahoma, and Oregon.
